Hi, i had this problem too, i found a solution: download msxml 4.0 and start the installation, choose remove from the menu and click next, this will remove it from your system, then, go back on the installer and proceed as usual, it should install it without any errors and then aoe3 will work. you will need the code anyway, which is usually stored with the game dvd in a box. Did you attempt to uninstall the 2 updates for msxml 4.0 and reinstall from windows update or download center? failing all of this, you will more than likely need the physical dvd to install the game.
